West Virginia is one of the handful of US states where real-money online casino play is licensed and regulated. That makes it unusual, and it also shapes what you will and won't find on this site. This guide sets out what West Virginia law allows as of October 2026, who regulates it, and where mystery pack sites fit in. It is general information, not a substitute for advice from a lawyer.
The short version
- As of October 2026, West Virginia licenses online casino games and online sports betting for players who are 21 or older and physically located in the state, each tied to one of its five licensed casinos.
- The West Virginia Lottery regulates all of it. The state has no statute that names online sweepstakes casinos, but the office of the state's chief legal officer issued subpoenas and warnings to operators in 2025 and most have since withdrawn from the state.
- As of October 2026, West Virginia law does not expressly address digital trading-card pack or mystery box purchases.
Online casinos: the Interactive Wagering Act
West Virginia passed its online casino law in 2019 and the first sites went live in July 2020. Under the Act, every online casino has to operate under the licence of one of the state's five casinos, and the West Virginia Lottery authorizes each platform. As of October 2026 the licensed brands include BetMGM, DraftKings, FanDuel, Caesars, BetRivers, Fanatics, bet365 and Golden Nugget, among others.
Two conditions apply to every player:
- Age. You must be 21 or older.
- Location. You must be physically in West Virginia when you play. Licensed apps check your location before every session.
Sports betting
Online and retail sports betting run under a separate 2018 law and launched that September, making West Virginia one of the first states to go live after the federal ban was struck down. The minimum age is again 21 and the Lottery is again the regulator. The same casino licences anchor the sportsbook apps.
Sweepstakes-style casino sites
West Virginia has not passed a law aimed specifically at dual-currency sweepstakes casinos, as of October 2026. Two 2026 bills that paired an online casino expansion with a sweepstakes ban, House Bill 161 and Senate Bill 118, died in conference in March 2026 and could return in 2027.
Enforcement has come instead from the office of the state's chief legal officer, which in 2025 sent subpoenas and enforcement warnings to dozens of sweepstakes operators, and in October 2025 state regulators said unlicensed sweepstakes-style platforms may not accept West Virginia players. More than 20 platforms stopped serving the state, and many national brands now list West Virginia among the states they exclude in their own rules. The state's position is that casino-style games offered to West Virginia residents must come from a Lottery-licensed operator.
For that reason this site does not review sweepstakes casinos, and you won't find any listed here.
Where mystery packs fit
Mystery pack and card-pack-opening sites sell a pack, box or digital "rip" at a set price, and you receive whatever card or item it contains. Many let you keep the item, have it shipped, or sell it back to the site.
As of October 2026, West Virginia law does not expressly address these purchases, and we found no Lottery or state enforcement statement or court decision about them. West Virginia's general gambling definition looks at three elements (paying something of value, a prize, and chance), so we review pack sites on how clearly they disclose what you're buying, what the odds and buyback terms are, and how easy it is to cash out or ship. Each site sets its own minimum age and eligible states, so check its terms before you buy.

West Virginia's five casinos
The state's casinos are Hollywood Casino at Charles Town Races in the Eastern Panhandle, Mountaineer Casino in New Cumberland and Wheeling Island in the Northern Panhandle, Mardi Gras Casino near Charleston, and the Casino Club at The Greenbrier in White Sulphur Springs, which admits only hotel guests and members. Four of the five are racetrack casinos with slots and table games. All admit players 21 and over.

Lottery and limited video lottery
The West Virginia Lottery has sold tickets since 1986 to players 18 and older. West Virginia also licenses limited video lottery terminals in bars, clubs and fraternal lodges, capped at a handful of machines per location, which is why small-town taverns across the state have slot-style machines.
